A BILL to amend article two, chapter thirty-three of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
ten-a, relating to requiring a rule prohibiting arbitrary
motor vehicle insurance rate raises within family residence.
Be it enacted by the Legislature of West Virginia:
That article two, chapter thirty-three of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
ten-a, to read as follows:
ARTICLE 2. INSURANCE COMMISSIONER.
§33-2-10a. Family purpose rule; commissioner to prohibit


arbitrary rate increases.


The commissioner shall, within his or her rule-making
powers, prohibit motor vehicle liability insurers from increasing the motor vehicle insurance rate of a parent or parents who have
a licensed and separately insured adult child living in their
residence or arbitrarily exclude that child from the parent's or
parents' motor vehicle policy coverage.
NOTE: The purpose of this bill is to prohibit motor
liability insurers from increasing the parents insurance rate
where a separately insured adult child is living at their
residence.
